What Is Probate?
Probate is the legal and financial process of managing a deceased person’s estate. It involves identifying and gathering assets, paying debts and taxes, and distributing what remains to the rightful beneficiaries.
You may need probate if you are named as an executor in a Will or are acting as an administrator where no Will exists (intestacy). A legal document—either a Grant of Probate or Letters of Administration—is required to give you the authority to carry out these responsibilities.
Typical duties include:
Valuing the estate and identifying all assets and liabilities
Completing inheritance tax returnsforms and liaising with HMRC
Applying for the appropriate Grant of Representation
Collecting in and distributing assets
Preparing estate accounts
At Farnworth Rose, we’ll handle as much or as little of this process as you need—whether it’s help with the grant alone, or full estate administration from start to finish.
Do I Need a Probate Solicitor?
While probate isn’t always legally required, it is highly recommended in many situations. If any of the following apply, it’s wise to speak with a solicitor:
The estate includes property, shares, or business assets
The estate is complex or subject to Inheritance Tax
There are disputes between beneficiaries
There is no valid Will or the Will’s authenticity is in question
You are unsure of your responsibilities and want legal protection
Probate can be time-consuming and legally intricate. Our role is to lift that burden and ensure every step is handled correctly—protecting you from future liability while offering peace of mind during a difficult time.
Fixed Fee Probate Services
At Farnworth Rose, we understand that dealing with probate can feel overwhelming, especially during a time of grief. To make the process easier and more predictable, we offer a clear, fixed fee probate service tailored to straightforward estates.
If the estate is simple and no Inheritance Tax (IHT) is due, we can apply for the Grant of Probate on your behalf for a fixed fee of £850 plus VAT. This service is ideal where the executors or family have gathered all the relevant financial information and simply need professional assistance in securing the grant.
Please note that in addition to our fixed legal fee, there is also a standard government probate application fee payable directly to the court. We’ll advise you on this and handle the process from start to finish, ensuring everything is submitted accurately and without delay.
Where Inheritance Tax is payable, and the family or executors have already collated all required information, we offer a comprehensive fixed fee of £1,250 plus VAT. This includes preparing and submitting the full Inheritance Tax return (IHT400), as well as applying for the Grant of Probate in appropriate cases.
Our fixed fee services are designed to give you peace of mind, with no hidden costs — just straightforward legal support, delivered with empathy and expertise.
